Terms and Conditions

 The following terms and conditions apply to all Subscribers of this service. The service (www.removalscentral.com ) offers removals and storage suppliers the opportunity to quote customers for moving, storage, packing and hire services online.   

Agreement

By submitting an Application Form, the party named in the form ("the Subscriber" or "You") agree to be bound by the terms and conditions of this agreement. The Subscriber understands that:

a)       completion and submission of an Application Form, does not guarantee that the Subscriber will be granted access to the service and RemovalsCentral.com will decide in our absolute discretion and negotiation will not be entered into;

b)       you must be operating as a removalist, storage, transport operator or packing or truck hire service at the time of application. Applications from brokers/ associations or other information providers who do not perform these functions directly will not be approved;

c)       you must pay subscription & commission fees and any other charges invoiced within 7 days, else late payment fees may apply or access may be temporarily suspended or permanently cancelled without refund;

d)       the subscription if granted is corporate and not personal and will not be transferable to another entity;

e)       information about the Subscribers company will be published online and available to the general public.

The Service

The service is a subscription to access the RemovalsCentral.com online removals quoting system for a full period of 12 calendar months from the date activated online for the regions to which the Subscriber is registered.

Use of the System

By submitting an application, the Subscriber agrees that:

a)       all information provided is true and correct

b)       the authorisation of the Subscriber to use this service does not imply that RemovalsCentral.com recommends or endorses the Subscriber, and ratings and testimonials provided on the service are not the opinion of RemovalsCentral.com and the Subscriber agrees not to represent themselves as such to the public.

c)       RemovalsCentral.com will not be held liable for any breaches of service delivery, breach of contract, outstanding debts from customers or be liable for any loss or damage whatsoever, incurred by the Subscriber as a result of accepting a booking from a customer sourced from this service.

d)       The Subscriber or any person authorised to use the system will not abuse the system (as described in this document) and understand that a breach may result in the termination of subscription without refund.

e)       A submission of a quote by the Subscriber represents a binding offer to the customer at a firm price. If the customer accepts that offer then the Subscriber is bound by those terms and price to the extent that the inventory and details submitted by the customer were accurate. Any amendments to the quote as a result of changes to details or inventory, must be negotiated with the customer prior to pick up.

f)         Any submission by the Subscriber of articles or information that will be made available to the users of this system will only be published at the discretion of RemovalsCentral.com and negotiation will not be entered into.

Fees, Commissions & Payments

By submitting the Application Form, the Subscriber agrees to pay the following fees, commissions and payments.

a)       The cost of using this service is made up of the subscription price, the commission and other relevant fees and charges as published in our Schedule of Fees & Charges.

b)       Subscription fees represent the cost of 12 months authorised access to the system and will be charged at the Scheduled Rate published at the time your application is received.

c)       Commission fees are calculated at the Scheduled Rate multiplied by the GST inclusive price of the quote submitted by you on the acceptance of that quote by the customer. This fee is collected by RemovalsCentral.com directly from the customer in the form of a booking deposit to secure the booking on your behalf. Please accommodate this commission in calculating the quote you will submit.

d)       The difference between the booking deposit and the commission payable to RemovalsCentral.com will be forwarded to you by cheque or bank transfer at your discretion within 24 hours of receiving that payment. If you cancel your services to the customer other than in accordance with the terms and conditions of your contract and they contact RemovalsCentral.com for a refund, this amount will be refundable to RemovalsCentral.com within 72 hours of the request received from the customer to enable us to refund the payment to the customer.

e)       If your quote is submitted on a "by the hour" basis, the commission will be calculated at a minimum flat rate.  The commission will be collected by RemovalsCentral.com directly from the customer through the booking fee to secure the booking on your behalf and the difference between the booking fee & our commission will be passed onto you within 24 hours of receipt of that payment.

f)         If an amendment is made to the quoted GST inclusive price on the date of service or if the job takes less than 3 hours (on a per hour basis), the Subscriber can apply to RemovalsCentral.com to have the commission calculated on the reduced price and a refund issued. This application must be supported by a legitimate tax invoice and may be confirmed with the client, prior to a refund being granted.

g)       If you cancel the service contract you have with the customer and the customer demands a refund from RemovalsCentral.com for their deposit, you will be required to reimburse RemovalsCentral.com for that refund. Failure to pay under the normal terms of payment may result in the termination of your subscription without refund and legal action may be pursued on behalf of the customer.

h)       Payments by credit card will be charged an additional service fee at the Scheduled Rate and payable at the time of payment.

i)         There is a monthly administration charge that will be charged at the Scheduled Rate if the Subscribers Application for Extended Payment is successful.

j)         There is a late payment penalty fee that will be charged at the Scheduled Rate if an account is not paid by the due date. Consecutive defaults on an account will result in a mandatory direct debit payment method or cancellation of your subscription without refund. RemovalsCentral reserves the right to withhold deposits from bookings to satisfy any overdue account balances.

k)       Payment terms will be 7 days unless otherwise stated and all amounts are in Australia Dollars and GST inclusive at the government imposed rate current at the time the invoice is raised.

Premium+ Self Storage Only

The following applies to Self Storage only providers who are on the Premium+ membership.

a)       The cost of using this service is made up of the subscription price, the commission and other relevant fees and charges as published in our Schedule of Fees & Charges.

b)       Subscription fees represent the cost of 12 months Premium listing online + access to customer requests that have been received online. You do not receive access into the online system, this process is managed through email requests only and your quote will be registered online by our staff.

c)       Commission fees are set at $15.00 per successful booking and will be collected out of your booking deposit as requested on your applciation form. RemovalsCentral receives a booking security deposit from the customer to secure the booking on your behalf.

d)       The difference between the booking deposit and the commission payable to RemovalsCentral.com will be forwarded to you by cheque or bank transfer at your discretion within 24 hours of receiving that payment.  

Money Back Guarantee

RemovalsCentral.com will refund the GST exclusive cost of the subscription or grant a free subscription for a further 12 months, if all of the following conditions are met. The subscriber:

a)       Must remain an active user of the system for the full period (ie cannot cease trading or stop using the system)

b)       Must retain a user rating throughout the entire period of 3 stars (average) or greater

c)       Must actively tender for a minimum of 50% of the requests received in that period

d)       The total value of successful tenders booked by customers in the period is not greater than the GST exclusive value of the subscription

e)       Must apply for the refund within 30 days of the end of the subscription period.

The terms of this guarantee are designed to ensure you actively participate in your subscription. By submitting the application form, the subscriber understands that if these conditions are not met, then they will forfeit the refund.

Extended Payment

The contract is for a 12 month subscription to the service. If you are approved for extended payments, this represents a payment solution not a monthly subscription. If you cease using this system or cease trading the full balance remaining on your account is payable in 7 days.

Failing to pay the full subscription for the 12 month period will result in legal action being taken to recover the debt.

Abuse of the Service

Abuse of the Service means the actual performance or intention to:

a)    use of this service illegally or failing to provide true and accurate information, deliberately misleading customers about the Subscriber

b)    minimise the operating capacity of the service or interfere or disrupt the operation or security of this service

c)     circumvent the system by directly contacting or soliciting contact to customers registered with this service

d)    circumvent the system by submitting quotes for companies who are not registered to the system

e)    access restricted areas of the database

f)     attempt to determine other suppliers quotations by posting "dummy requests" online

g)    secure a booking without committing to the quoted price for the inventory listed by the customer or failing to provide full details about the full cost of the service. (eg if continual notification is received from customers that the Subscriber changes the quote after booking or performing the service or add charges on without notification, the subscription may be suspended pending investigation or terminated completely.

h)    fail to pay fees or commissions owing to RemovalsCentral.com

i)      fail to perform services which have been booked (ie failing to attend or failing to perform services as quoted)

j)      inappropriate behaviour by any member of staff to a customer or staff member of RemovalsCentral.com

k)     send unsolicited electronic mail to RemovalsCentral.com staff or customers maintained on our database.

l)      any continual and justified  complaints lodged by customers about the performance of your obligations under their contracts

Subcontracting

Whilst RemovalsCentral understands that subcontracting is an important part of the industry, it often leads to uncompetitive quotes and customer dissatisfaction. By using the priviledge of subcontracting your work, you agree to adhere to the following subcontracting conditions, understanding that:

a)      The contract for the work always remains between your comppny and the customer and you are liable for any claims for damages, loss or otherwise and complaints as a result of the subcontractors work. There will be no passing off the customer to the subcontractor for resolutions.

b)      You will only subcontract work where you cannot perform the work yourself.

c)      You will notify the customer prominently in the notes or standard terms and conditions of your quote that their job may be subcontracted and the name of the company who will perform the work. Subcontracting the work after the event without notifying the customer prior to the booking will not be tolerated as it prevents the customer from deciding if they are comfortable with who they are using.

d)      You must demonstrate and maintain quality control standards over your subcontractors. Any resulting customer feedback and testimonials or ratings will be registered to your online account and you will wear the benefits and detriments of your subcontractors business practices.

e)      If we receive a continual pattern of complaints or claims from customers throughout the period of your membership as a result of their dissatisfaction with your subcontractors work and you do not rectify the issue on notice with new quality control standards or a change in subcontractor (as required), the priviledge of subcontracting may be withdrawn for the remainder of your membership and any evidence that you are continuing to subcontract is a breach of terms and conditions that may result in a permanent termination of your membership.

f)      If it can be demonstrated that you are quoting jobs and subcontracting it in a "broker" style arrangement (where you never intend to perform the work - but are simply farming out jobs to non members) we will permanently terminate your membership without recourse.

g)     We reserve the right to remove this permission at any time from one or all members to subcontract work if it is found to result in a continual pattern of dissatisfaction from our customers.

Customer Relations

By submitting the Application Form, the Subscriber agrees and understands that:

a)       they are prohibited to contact or attempt to contact a customer, or induce, coerce or instruct a customer to contact them directly. Any contact or attempt to contact prior to the official booking by that customer may result in the termination of subscription without refund.

b)       If a quote has been submitted to the system for a customer and the customer contacts the Subscriber directly whether by their own free will or under coercion or inducement by the company and chooses to use the Subscribers service, then the commission will remain payable to RemovalsCentral.com by the Subscriber.

c)       An acceptance of a quote by a customer represents a binding contract under applicable State and Federal law and is made between the Subscriber and the customer. At no time is RemovalsCentral.com expressly or implied to be a party to that contract.

d)       Any information made available through this system about the customer will be handled by the Subscriber in accordance with the relevant Privacy Act regulations.

Termination

RemovalsCentral.com and the Subscriber may each terminate this Agreement at any time giving the other party not less than seven (7) days notice, either written or electronically.

1)       If the Subscriber terminates their subscription it is understood that they are not entitled to a refund. Any refund requested will be at the sole discretion of RemovalsCentral.com.

2)       If RemovalsCentral.com terminates a subscription as a result of a breach of these terms and conditions or as a result of an abuse of the system, no refund will be provided. A refund may be applied for by the Subscriber in writing, however the decision will be made solely at the discretion of RemovalsCentral.com and negotiation will not be entered into.

Upon termination of this agreement:

a)       the Subscriber will no longer be entitled to use the Service and the Subscribers username and password access will be cancelled immediately.

b)       the Subscriber will pay RemovalsCentral.com all fees and charges owing to RemovalsCentral.com, within seven (7) days of the date of termination, otherwise legal proceedings may be pursued.

c)       RemovalsCentral.com will refund the Subscriber any credit amounts greater than $10.00 (AUD) remaining in their account as a result of adjustments to the Commission Fees that have been accepted. If the balance is below this amount, the Subscriber forfeits the refund.

d)       Any amounts in credit on the Subscribers account, will be applied to any amounts outstanding on the Subscribers account prior to any refund being given.  

Liability & Warranties

a)       RemovalsCentral.com provides no warranties and accepts no liability for the operational capabilities of the system, nor failure in performance of the system.

b)       RemovalsCentral.com will not guarantee the accuracy of the information provided by the customer

c)       RemovalsCentral.com will not provide warranty or guarantee to the accuracy of any information on the website submitted by subscribers

d)       RemovalsCentral.com does not endorse or support the recommendations, ratings or testimonials provided by customers who have used the service, nor does this rating or testimony represent the opinion of RemovalsCentral.com at any time and representation as such is misleading and deceptive conduct.

e)       RemovalsCentral.com is not an agent or associated or related party to any Subscriber listed on this site.

f)         RemovalsCentral.com prohibits any advertising or marketing or use of our name, trademark or logo by any person on their own site or material, without the express written consent of RemovalsCentral.com. Any misleading advertising or information released by any person, that misleads customers, or attempts to relate or associate RemovalsCentral.com with any other brand, trademark or business operation without consent, will be prosecuted.

g)       RemovalsCentral.com requests that if anyone wishes to provide a link to RemovalsCentral.com from their own site, that a request be made in writing and we will authorise our trademarked corporate logo and link for your use.

h)       RemovalsCentral.com is not responsible nor will be held liable for any breach or failure to adhere to any service delivery standards or promises made by the Subscribers or advertisers to this service. Nor will RemovalsCentral.com be held liable for any damage or loss that is suffered by a customer or Subscriber, either material or financial by any party providing or receiving services as a result of using this site
