The following terms and conditions apply to all Advertisers on this service.
Agreement
By submitting an Application Form, the party named in the form (“the Advertiser” or “You”) agree to be bound by the terms and conditions of this agreement. The Advertiser understands that:
a) completion and submission of an Application Form, does not guarantee that the Advertiser will be granted an advertisement on the service. The decision is for RemovalsCentral.com to make in its absolute discretion and negotiation will not be entered into;
b) they must pay the advertising fee and any other charges invoiced within 7 days, else late payment fees may apply and your advertisement will be temporarily removed until payment is received, there will be no extension of the advertising period as a result of your advertisement being withdrawn during this period;
c) information about the Advertisers company will be published online and available to the general public.
d) You will receive correspondence from RemovalsCentral.com via email about your account, your advertisement and special offers from time to time.
The Service
The service is advertising on the RemovalsCentral.com online Services Directory or Transportation Directory for a period of 12 calendar months from the date activated online for the regions to which the Advertiser is registered to.
Fees, Commissions & Payments
a) The cost of advertising on this service is made up of the advertising price, and other relevant fees and charges.
b) Advertising fees represent the cost of 12 months authorised advertisement on the RemovalsCentral.com Services Directory or Transportation Directory.
c) Payments by credit card will be charged a service fee of 2% on the total amount payable at the time of payment.
d) There is an $11.00 late payment penalty if an account is not paid by the due date. Failure to pay will result in your advertisement being removed from the site.
e) Payment terms will be 7 days unless otherwise stated and all amounts are in Australia Dollars and GST inclusive at the government imposed rate current at the time the invoice is raised.
Free Listing
Additional terms & conditions of the free listing offered to Australian businesses are as follows:
a) One free listing per business per region. Free listings will only be approved for the regions in which your offices are physicaly located, where customers can visit your office premises in that area.
b) The listing will be reviewed to determine appropriateness of information content and relevance to the region & category you have applied for. Links posted on this site are completely at the discretion of RemovalsCentral.com management and all decisions are final and negotiations will not be entered into.
c) Your free listing will include a 100 character description of your company, and email link to a contact form and a website link to your own websites homepage. Applications received with telephone numbers or addresses or other contact information in the description section will not be approved. Such information is reserved for Upgraded or Premium Listings only. If you require this information, you must purchase an upgraded or premium listing.
d) The listing will be published online for 365 consecutive days and will be removed from the system in the case of you being unable to be contacted on the email address you have posted. If your website cannot be linked to at any time during this advertising period, your advertisement will be removed without notice.
e) If RemovalsCentral.com receives an application for an additional or ongoing advertising solution from the applicant in the first 30 day after initial application, the applicant will be entitled to 10% of the advertised price at the date the application is received.
f) The publication of advertisements is solely at the discretion of the management of RemovalsCentral. We reserve the right to remove advertisements at our discretion without notice and will not at any time re-imburse applicants for loss of revenue or otherwise as a result of removing your advertisement from the system. This is a free product and no warraties, liabilities or responsibilities will be taken for it. We reserve the right to withdraw this free offer at any time.
Use of the System
By submitting an application form, the Advertiser agrees that:
a) all information provided is true and correct
b) the authorisation of the Advertiser to use this service does not imply that RemovalsCentral.com recommends or endorses the Advertiser and the Advertiser agrees not to represent themselves as such to the public.
c) RemovalsCentral.com will not be held liable for any breaches of service delivery, breach of contract, outstanding debts from customers or be liable for any loss or damage whatsoever, incurred by the Advertiser as a result of sourcing a customer from this service.
d) The Advertiser or any person authorised to use the system will not abuse the system (as described in this document) and understand that a breach of this clause may result in the termination of their advertisements without refund.
e) Any purchase of products or services made with a customer is a contract between the Advertiser and the customer. At no time is RemovalsCentral.com deemed or implied to be a party to any contract. It is your responsibility to communicate with the customer about your terms and conditions of any transactions.
f) Any text, material, images and graphics on the site is owned by RemovalsCentral.com unless expressly indicated on the site. The content is protected by Australian and International intellectual property laws. It is an offence to copy, use or illegally download this information with the intention to reproduce or use this information. Apart from any use permitted under the Copyright Act 1968 (Cth) Australia, you must not modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute, translate, adapt, alter, decompile, disassemble, reverse engineer or create any derivative work of the Content in any way except as expressly authorised in writing by RemovalsCentral.com.
Abuse of the Service
a) Abuse of the Service means the actual performance or intention to:
b) use of this service illegally or failing to provide true and accurate information that deliberately misleads customers.
c) minimise the operating capacity of this service or interfere or disrupt the operation or security of this service
d) fail to pay fees or commissions owing to RemovalsCentral.com
e) inappropriate behaviour by any member of staff to a customer or staff member of RemovalsCentral.com
f) including a link to a content inappropriate website in your advertisement
g) spam or send unsolicited electronic mail to RemovalsCentral.com staff or customers maintained on our database.
h) any continual and justified complaints lodged by customers about the performance of service obligations
Termination
RemovalsCentral.com and the Advertiser may each terminate this Agreement at any time giving the other party not less than seven (7) days notice, either written or electronically.
1) If the Advertiser terminates this agreement it is understood that they are not entitled to a refund. Any refund requested will be at the sole discretion of RemovalsCentral.com.
2) If RemovalsCentral.com terminates a subscription as a result of a breach of these terms and conditions or as a result of an abuse of the system, no refund will be provided. A refund may be applied for by the Advertiser in writing, however the decision will be made solely at the discretion of RemovalsCentral.com.
Upon termination of this agreement:
a) the Advertiser will no longer be entitled to list their advertisement.
b) the Advertiser will pay RemovalsCentral.com all fees and charges owing to RemovalsCentral.com, within seven (7) days of the date of termination, otherwise legal proceedings may be pursued.
Liability & Warranties
RemovalsCentral.com:
a) provides no warranties and accepts no liability for the operational capabilities of the system, nor failure in performance of the system and there will be no refunds given for downtime of the servers.
b) will not provide warranty or guarantee to the accuracy of any information on the website submitted by Advertisers
c) does not endorse or support the advertising information provided by Advertisers on the Directories nor does this information represent the opinion of RemovalsCentral.com at any time and representation to the public as such is misleading and deceptive conduct.
d) is not an agent or legally associated to any Advertiser listed on this site.
e) prohibits any advertising or marketing or use of our name, trademark or logo by any person on their own site or material, without the express written consent of RemovalsCentral.com. Any misleading advertising or information released by any person, that misleads customers, or attempts to relate or associate RemovalsCentral.com with any other brand, trademark or business operation without consent, will be prosecuted.
f) requests that if anyone wishes to provide a link to RemovalsCentral.com from their own site, that a request be made in writing and we will authorise our trademarked corporate logo and link for your use.
g) is not responsible nor will be held liable for any breach or failure to adhere to any service delivery standards or promises made by the Advertisers on this service. Nor will RemovalsCentral.com be held liable for any damage or loss that is suffered by a customer or Advertiser, either material or financial by any party providing or receiving services as a result of using this site.
h) does not control the information on the websites linked to the Advertisement listing and does not endorse it. It is the users responsibility and discretion to follow a link placed on our site and RemovalsCentral.com will not be held liable for any consequence of such an action. |
